International Mobility Program
Overview
The International Mobility Program (IMP) allows Canadian employers to hire foreign workers without the need for a Labour Market Impact Assessment (LMIA). The program aims to advance Canada’s broad economic, social, and cultural interests by facilitating the entry of workers who can contribute to various sectors. The IMP includes various streams that cater to different types of foreign workers, including those involved in trade agreements, intra-company transfers, and individuals bringing significant benefits to Canada.
Key Features of the IMP
- No LMIA Required: Unlike the Temporary Foreign Worker Program (TFWP), the IMP does not require employers to obtain an LMIA.
- Various Streams: The program includes several streams, such as international agreements (e.g., NAFTA), intra-company transfers, and significant benefit categories.
- Work Permits: Issued to foreign workers based on the specific stream under which they apply, allowing them to work in Canada temporarily.
Eligibility Criteria
To qualify for the International Mobility Program, foreign workers must meet the requirements of the specific stream under which they are applying. Some of the common streams include:
International Agreements
- Workers covered under international agreements such as NAFTA, CETA, and other trade agreements.
- Examples: Professionals, intra-company transferees, traders, and investors.
Intra-Company Transfers
- Employees of multinational companies who are being transferred to the Canadian branch, affiliate, or subsidiary of their company.
- Requirements: Minimum one year of employment with the company, specialized knowledge or executive/managerial role.
Significant Benefit
- Workers who can demonstrate that their employment in Canada will result in significant social, cultural, or economic benefits.
- Examples: Entrepreneurs, self-employed individuals, researchers, and performers.
Canadian Interests
- Workers whose employment is in the interest of Canada, including reciprocal employment, designated by the Minister, and charitable or religious workers.
Required Documents
When applying for a work permit under the IMP, applicants generally need to provide the following documents:
Job Offer
- A valid job offer from a Canadian employer, detailing the terms of employment.
Proof of Employment Relationship
- For intra-company transfers, proof of the employment relationship and evidence of the qualifying position.
Supporting Documents
- Depending on the stream, this may include educational credentials, professional qualifications, and evidence of significant benefit to Canada.
Passport and Travel Documents
- Valid passport or travel documents for the applicant and accompanying family members.
Application Process
Employer Submits Offer of Employment
- Employers submit the job offer through the Employer Portal and pay the employer compliance fee.
Foreign Worker Applies for Work Permit
- With the job offer number provided by the employer, the foreign worker applies for a work permit online or at a visa office.
Processing and Decision
- IRCC reviews the application and may request additional documents or information. If approved, a work permit is issued.
Travel to Canada
- Upon arrival, the foreign worker presents their work permit approval letter and supporting documents to a border services officer, who issues the work permit.
Rights and Protections
- Workplace Rights: Foreign workers have the same rights and protections as Canadian workers, including fair wages, safe working conditions, and the right to join a union.
- Health and Safety: Employers must ensure a safe work environment and provide necessary health and safety training and equipment.
- Complaints and Violations: Foreign workers can file complaints with ESDC if their rights are violated, and employers may face penalties for non-compliance.
